Law No. 6698 on the Protection of Personal Data Clarification Text

At PINAR YÜCEL / REAL ESTATE, we are committed to protecting the privacy and security of your personal information. With this awareness, as a Company, we attach great importance to the processing and preservation of all types of personal data of all persons associated with the Company, including those who benefit from our products and services, in accordance with the Personal Data Protection Law No. 6698 ("PDPL") and the European Union General Data Protection Regulation (GDPR) of May 25, 20 In full compliance with this responsibility, we process your personal data as a "Data Controller" within the meaning of the Law, as explained below and within the limits prescribed by the Law.

1. Data Controller, Data Processor and Data Protection Controller

Pursuant to Law No. 6698 on the Protection of Personal Data ("PDP Law") and as data controller and data processor; As a data processor pursuant to the GDPR, your personal data may be processed by PINAR YÜCEL / REAL ESTATE, located at Keller Williams Platin&Karma Regional Directorate, Akatlar, MKM, Uğur Mumcu Cad.  No: 8/5, 34335 BEŞİKTAŞ / İSTANBUL / TURKEY within the scope described below.

2. Collection, Processing and Purpose of Personal Data Processing

Your personal data collected will be processed within the framework of the personal data processing conditions, principles and purposes specified in Articles 5 and 6 of the PDP Law and in the second part of the GDPR (art.5-m.11) within the framework of the necessary work carried out by our business units to benefit you from the products and services offered by our Company, customizing the products and services offered by our Company according to your tastes, usage habits and needs and recommending them to you; ensuring the execution of our Company's human resources policies; ensuring the legal and commercial security of our Company and the persons who have a business relationship with our Company; to carry out our commercial activities for the purposes of determining and implementing our Company's commercial and business strategies.

In addition, your personal data may be processed when you use our call centers or our website to obtain services from the Company or our affiliates, when you visit the Company or our website, when you participate in training, seminars or organizations organized by the Company, when you apply for a job with the Company.

Your personal data collected will be processed within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the PDP Law and the second part of the GDPR (Art 5.-Art 11) for the purposes of carrying out the necessary work by our business units to benefit you from the products and services offered by our Company, customizing the products and services offered by our Company according to your tastes, usage habits and needs, ensuring the legal and commercial security of our Company (Administrative operations for communication carried out by our Company, physical security and supervision of the Company's locations, reputation research processes, event management, legal compliance process, audit, financial affairs, etc.) and the persons who have a business relationship with our Company, determining and implementing the commercial and business strategies of our Company and ensuring the execution of our Company's human resources policies.

3. To Whom and for What Purposes the Processed Personal Data May Be Communicated

Your collected personal data may be transferred to our business partners, suppliers, Company officials, shareholders, legally authorized public institutions and private persons within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the PDP Law and in the second part of the GDPR (Art.5-Art.11) for the purposes of carrying out the necessary work by our business units to benefit you from the products and services offered by our Company, determining and implementing the commercial and business strategies of our Company and ensuring the execution of our Company's human resources policies, customizing the products and services offered by our Company according to your tastes, usage habits and needs and recommending them to you, ensuring the legal and commercial security of our Company and the persons who have a business relationship with our Company (administrative operations for communication carried out by our Company, ensuring the physical security and control of the Company's locations, business partner / customer / supplier  (authorized or employees) evaluation processes, reputation research processes, legal compliance process, audit, financial affairs, etc.).

4. Personal Data Collection Method and Legal Basis

Your personal data will be collected in all types of oral, written or electronic media in order to provide the products and services offered by the Company, in accordance with the above-mentioned purposes, within the established legal framework and, in this context, in order for our Company to fully and accurately comply with its contractual and legal obligations. Your personal data collected for this legal reason may also be processed and transferred  for the purposes specified in Articles (2) and (3) of this text, within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the PDP Law and in the second part of the GDPR (Art. 5-Art. 11).

5. Rights of the Owner of the Personal Data  Listed in Article 11 of Law No. 6698

If you, as the owner of personal data, submit your requests regarding your rights to our Company by the methods set forth below in this Clarification Text, our Company will complete the request free of charge within thirty days at the latest, depending on the nature of the request. However, if a fee is required by the Personal Data Protection Board, the fee will be charged at the rate set by our Company. In this context, the owners of personal data have the following rights;

Find out if their personal data is being processed,

Request information on whether their personal data is being processed,

Know the purposes for which their personal data is being processed and whether it is being used for its intended purpose,

To know the third parties to whom the personal data is communicated in the country or abroad,

To request the rectification of personal data in case of incomplete or inaccurate processing, and to be informed of the operations carried out in this context with third parties to whom personal data have been communicated.

To request the cancellation or destruction of personal data, even if they have been processed in compliance with the provisions of the Privacy Code and other relevant laws, if the reasons for their processing no longer apply, and to request that third parties to whom personal data have been communicated be informed of the operations carried out in this context,

To object to the use of data processed with the aid of automated systems, even if such use is unfavorable to the data owner,

In case of damage caused by the unlawful processing of personal data, to obtain compensation for the damage. 

6. Rights of Personal Data Owners under the European Union General Data Protection Regulation (GDPR)

The right to transparent information regarding the exercise of the data owner's rights,

When personal data relating to the data owner are collected from the data owner, the right to be informed of the identity and contact details of the controller and, where appropriate, of the identity and contact details of the representative of the controller and, where appropriate, of the contact details of the data protection officer, as well as of the purposes of the processing of personal data and the legal basis for the processing,

The right to be provided with the information set out in Article 14 of the GDPR,  if the personal data have not been obtained from the data owner,

The right of the data owner to verify with the controller whether personal data concerning him or her are being processed and, if so, to obtain access to the personal data and the following information

The right of the data owner to request the controller to rectify inaccurate personal data concerning him/her without undue delay,

The right of the data owner to obtain the completion of incomplete personal data, including by means of a supplementary declaration, taking into account the purposes of the processing,

The right of the data owner to demand from the controller the deletion of personal data concerning him or her without undue delay,

The right of the data owner to request the controller to restrict the processing,

The right to receive the personal data that the data owner has provided to a controller in a structured, commonly used and machine-readable format,

The right to transmit such data to another controller without hindrance from the controller to whom the personal data was provided,

The right of the data owner at any time to object to the processing of personal data concerning him or her,

The right of the data owner to not be subject to a decision based solely on automated processing, including profiling, which has legal consequences for him or her or similarly significantly affects him or her,

Pursuant to paragraph 1 of article 13 of the PDP Law, you may submit your request to exercise the above-mentioned rights to our Company in writing or in any other manner determined by the Personal Data Protection Board. Since the Personal Data Protection Board has not yet established a method, you must submit your request to our Company in writing in accordance with the PDP Law. In this regard, the channels and procedures for you to submit your written request to our Company under Article 11 of the PDP Law are explained below.

In order to use your rights mentioned above, you may submit your request containing the necessary information identifying your identity and your explanations regarding your right you request to use from the rights specified in Article 11 of the PDP Law on the https://pinaryucel.com/ web address and send a signed copy of the form to "PINAR YÜCEL REAL ESTATE" by hand, through a notary public or other methods specified in Law No. 6698, or you can send the relevant form to pinar.yucel@kww.com.tr with a secure electronic signature.
